1. Scope and contract language

These terms govern your use of the PolyTake app and this website. They are provided in English. Mandatory consumer protections under the law of your country of residence remain unaffected.

3. Description of the service

PolyTake lets several iPhones record the same moment together. One device hosts an event, others join as guests, all cameras start at the same time, the guests' clips are transferred to the host over the local network, and the app cuts them into one movie on the host's device.

PolyTake works over the local network between devices that are physically close to each other. It needs no user account and no internet connection for recording. We do not guarantee any particular editing result, and the automatic cut is a creative aid rather than a promised outcome.

4. Requirements

PolyTake requires a compatible iPhone and access to the camera, the microphone and the local network. Some features, such as estimating where the other cameras are, need hardware that not every device has. Connection quality between devices depends on your surroundings and is outside our control.

5. Free use, Host and purchases

Joining an event is free and does not require a purchase. Starting your own events requires Host, which is available as a subscription or as a one-time purchase after your first free event.

All purchases are made through Apple's App Store. Apple is the seller. Prices are shown in the app before you buy, in your local currency including applicable taxes.

6. Subscriptions and renewal

A Host subscription renews automatically for the same period until you cancel it. Cancellation is done in the Apple ID subscription settings on your device, at the latest 24 hours before the current period ends. Your access continues until the end of the period you have paid for.

7. Your content and your responsibility

Everything you record stays yours. We claim no rights to your recordings and receive no copy of them.

You are responsible for what you record and for whom you share it with. Filming other people can require their consent, and rules differ by country and by place. Please respect the rights of everyone in front of the camera and do not use PolyTake where recording is not allowed.

When you take part in an event, your clip is transferred to the host's device. Please only join events you are comfortable handing your footage to. Once transferred, only the host can delete their copy.

8. Right of withdrawal for consumers

Purchases are concluded with Apple, so withdrawal and refunds are handled under Apple's terms through Apple's own process, which you can start from your purchase history. Statutory consumer rights remain unaffected.

9. Warranty

Statutory warranty rights apply. We provide the app with the functionality described at the time of purchase and do not warrant that it will be free of interruption or error, in particular where wireless conditions, device limitations or operating system changes affect it.

10. Liability

We are liable without limitation for injury to life, body or health, for intent and gross negligence, and under the German Product Liability Act. For slight negligence we are liable only where an obligation essential to the purpose of the contract is breached, and then limited to the foreseeable damage typical for this type of contract. Any further liability is excluded.

This applies in particular to lost recordings. Because your footage exists only on your own devices, please make your own copies of anything you want to keep.

11. Availability and changes

We may develop the app further, change features or discontinue the service, taking your legitimate interests into account. Where a change materially affects a paid subscription, you may cancel it.

12. Online dispute resolution

The European Commission provides a platform for online dispute resolution at ec.europa.eu/consumers/odr. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.

13. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of residence.

Should individual provisions be or become invalid, the validity of the remaining provisions is unaffected.
